Time’s Up, Pencils Down… Maybe

In March 2020 New Jersey Governor Phil Murphy signed Executive Order No. 103 (EO 103) due to the COVID-19 pandemic.   As a result of EO 103, the New Jersey Department of Environmental Protection (NJDEP) Site Remediation and Waste Management Program (SRWMP) issued Notices of Rule Waiver/Modification/Suspension (Notice).   The Notice allows for the extension of applicable timeframes for the person responsible for conducting remediation (PRCR).  

Recently, the NJDEP SRWMP has released an update and new guidance documents pertaining to extension requests for PRCRs.   The updates include a new website with EO 103 extension documents that were not included in the previous Notice, as well as specific extension guidance documents depending on the type of remediation applicable for a PRCR.   These include guidance on the extension process for “soil-only” cases, withdrawal of remedial action permit (RAP) applications, sites under Administrative Consent Orders (ACOs), and investigations for certain underground storage tanks (USTs).
